Flooant Terms and Conditions
The Flooant website and mobile application for Android and iOS are managed and operated by Flooant, LLC. By using any part of the Flooant service, you acknowledge that you have read and understood the terms and conditions highlighted on this page, including future changes to these terms. When terms and conditions are updated, we will indicate by the date at the bottom of this page. If you do not agree to these terms, you are not obligated to use the Flooant service.
Description of Flooant Service
The Flooant Service offers users to teach and learn foreign languages through the use of the Flooant mobile application. Both Teachers and Students receive incoming calls from Flooant when a connection is made through the app. Teachers and Students will not be responsible for international long distance phone charges, but will, however, be responsible to pay any data usage related to normal in-country calls associated with their phone plan.
Registration as a Flooant Teacher or Student
By registering as a Flooant Teacher or Student, you agree to provide accurate information, including your telephone number, teaching experience and credentials and reviews and comments. You agree not to mislead any students or teachers and acknowledge that the language you indicate as your “native language” is in fact the first language you learned to speak since your birth. If at any time a teacher falsifies information about their native language skills, Flooant reserves the right to block their account and deny them teaching privileges.
B. Teaching CONTRIBUTOR participation
If you are or become a Flooant Teacher, you acknowledge that the language you have registered to teach is your native language, and that you agree with and accept the Flooant Teacher Policy. Flooant reserves the right to revoke your teaching status based on falsifying the claim of a native language, on a case-by-case basis. As a Flooant Teacher, you will do your best to hold a conversation with your student during the duration of the practice session, as defined by the product description on the website. You will be compensated based on the completion of practice sessions with students, where you have received a practice rating of 2/5 stars or greater, per the student evaluation. Any conversation held through the Flooant application is also the property of Flooant, however Flooant does not have the right to share or distribute personal information shared by you and the student during the conversation. However, if requested by law, information you share with a Flooant student, through a paid teaching conversation, may be used as documentation in a court of law. Flooant reserves the right to use teacher reviews submitted through the Flooant app in marketing and promotional purposes without written consent from the Teacher or Students registered with Flooant.
C. GENERAL CONTENT Terms
All content submitted and used on the Flooant website or mobile applications is the property of Flooant and Flooant reserves the right to use all content from the website and application in marketing materials without obligation to pay students or teachers royalties, including use of teacher and student photographs, comments, reviews and profile descriptions. Flooant can use this content on social media without consent from teachers or students.
Your password and information
As a Flooant Teacher or Student, you must protect your password and private registration information. Do you not share your password with others, and do not allow others to use your password to login to your account or act in your behalf. If Flooant discovers that another person has logged in as you and pretended to be you, Flooant reserves the right to remove your registration and teaching or student status from the application
You will not upload or submit inappropriate content in the Flooant app or on social channels if you are a teacher. Inappropriate content includes, but is not limited to, nudity, profanity, hate speech or discriminatory or racist remarks of any kind. Flooant will remove access to your account if inappropriate content is uploaded to your profile as a Teacher. Students that leave inappropriate content in Teacher reviews will be blocked from further use of the Flooant app.
Flooant call charges
If you register as a Student in the Flooant app, and initiate a language conversation with a teacher, you will be billed for the conversation minutes that you had with a teacher, according to the indicated rate per minute for your conversation. You will not be able to initiate an additional speaking session with a teacher until you have fully paid for your previous conversation. Flooant reserves the right to Block students from initiating Learning Conversations with Flooant Teachers if they have an outstanding balance from a previous Learning Conversation. Upon completion of a Learning Conversation, all Flooant Students must pay their balance in full within a 24 hour period, or they will be blocked as a Flooant Student until they have paid their balance in full.
Flooant may update the pricing of Learning Conversations, or our service, at any time in its sole discretion, and may add new additional fees to the service. Flooant will indicate to the Students the fee for the Learning Conversation prior to each call. Flooant Students have responsibility to pay for any additional charges incurred by their phone service provider, that are incurred as a result of placing calls through the Flooant app. Flooant will use the country code of the Student’s location (as indicated through the phone number the Student provides during registration) to direct calls. For example, a Flooant Student that has registered their phone number with the country code of “1” (USA or Canada) will dial a Flooant registered phone number that begins with the country code of “1.” That call will then forward to the Flooant Teacher, who may be located any where in the world. The charge for the call from the Flooant registered number beginning with the country code of “1,” to the destination of the Teacher, wherever they are located, will be paid for by Flooant.
Data charges incurred by Flooant Students and Teachers will be the sole responsibility of Flooant Students and Teachers. Flooant will not pay for or reimburse Flooant Students or Teachers for any data or call charges incurred through use of the Flooant app. Flooant Students and Teachers must agree to pay all charges incurred by their phone service provider prior to using the Flooant app for Learning or Teaching Conversations.
You agree to pay all fees and applicable taxes incurred by you or anyone using a Flooant account registered to you. Flooant may revise the pricing for the goods and services offered through the Service at any time. All information that you provide in connection with a purchase or transaction or other monetary transaction interaction with the Service must be accurate, complete, and current. You agree to pay all charges incurred by users of your credit card, debit card, or other payment method used in connection with a purchase or transaction or other monetary transaction interaction with the Service at the prices in effect when such charges are incurred. You will pay any applicable taxes, if any, relating to any such purchases, transactions or other monetary transaction interactions.
third party Payment Processors
Flooant is not responsible for third party payment processor errors or payment issues. If you pay with a credit card, through PayPal, Apple Pay or Google Pay and the payment processor encounters an issue, you are responsible to resolve the issue with the relative third party. Flooant will try to help you understand the issue, but is not responsible for third party payment errors.
If you were charged for a call inaccurately based on the rate per minute posted in the app, or did not receive your first five minutes free (as a Student, only when this promotion is written directly in the app; limited time), Flooant will refund to you the charge. Please email firstname.lastname@example.org to describe the mistake if this occurred, and we will respond with a resolution as soon as possible.
B. Poor experience
In the event of a poor conversational experience resulting in your elected rating of 2/5 stars or lower, Flooant will, at its option, either (a) provide the user with a refund for the affected conversation, or (b) use reasonable efforts to resolve the Conversation Issue. Whether an issue constitutes a Conversation Issue will be determined by Flooant in its reasonable discretion. For clarity, Flooant may terminate or suspend your account without notice if you violate Section 5, Inappropriate Behavior, or violate the Flooant Teacher Policy regarding the Conversation rules and procedures. If you violate these terms and conditions, you will not receive payment for the services which you have rendered that were in violation of Flooant policies.
If you are a Flooant Student, you will receive a refund for any conversation you paid for in which a Flooant Teacher violated our Flooant Teacher Policy. The amount of any refund will depend on the nature of the Conversation Issue and will not exceed the total amount actually paid by the user for the affected conversation. To submit a valid claim for a refund, a user must (a) submit the Conversation Issue in writing to Flooant within 48 hours after the Conversation Issue occurs, and respond to Flooant requests for information or cooperation, (b) not have directly or indirectly caused the Conversation Issue, and (c) have met all test requirements when participating in a conversation prior to making a claim for a Conversation Issue.
Flooant Students will not be refunded for and Flooant Conversations they have paid for if they have violated Flooant Terms and Conditions, specifically related to Section 5, Inappropriate Behavior.
Flooant Students and Teachers will not receive refunds if they have violated Flooant Terms and Conditions as described here, and on https://www.flooant.com/terms-and-conditions/ .
Third-Party Links, Sites, and Services
The Flooant website and app may contain links and advertisements from third parties that are not associated with Flooant. Flooant is not responsible for the content and experience of the third party sites. Clicking on ads on the Flooant website is an optional activity done by a user, and once the user leaves the Flooant website or mobile applications, the user should refer to the terms and conditions of the third party site they are visiting if any issues are encountered.
Flooant may terminate account access to both Teacher and Students if they violate the terms and conditions written on this page, or if the Student or Teacher violates any U.S. law.
“Flooant,” “Practice Makes Flooant” and the Flooant logo and “a” logo are trademarks of Flooant LLC, and may not be used without express permission of Flooant. The Flooant name and the app icon are registered trademarks and may not be used graphically or in text without permission from Flooant LLC.
